Lewis, Individually d/b/a Winchester Court Amoco, Winchester Court Amoco and Amoco Oil Company; in the Circuit Court of DeSoto County; Mississippi Case No. CV-98-309
In 1997, a group of teenagers were involved in a tragic accident near Memphis at the state line between Tennessee and Mississippi. One young lady became a paraplegic as the result of the accident, another young lady had over one million dollars in medical bills as a result of the horrendous injuries she suffered, and two people died in the wreck.
The two young women, along with the estate of the deceased driver, sued a number of defendants, including Amoco Oil Company. Plaintiffs alleged that one of the teenagers had purchased beer illegally at an Amoco branded station, that the driver of the vehicle consumed the beer and became intoxicated, and that this led to the accident.
The trial court granted summary judgment on behalf of Amoco Oil Company, adopting Mr. Reynolds’ argument that the Tennessee Dram Shop law should be applied in the case and, under Tennessee law, the Plaintiffs were barred from suing Amoco under the facts of the case.
