Jeff Reynolds Obtains Summary Judgment for BP in Premises Liability Case

In August of 2008, Mr. James Hawthorne allegedly stole beer from a BP branded station in Jackson, Mississippi. Mr. Sarbriner Pannu, the operator of the station, chased down Mr. Hawthorne and then shot and killed him.

The heirs of Mr. Hawthorne sued Mr. Pannu and a number of other Defendants, including BP. They alleged that Mr. Pannu was the agent and/or employee of BP and therefore BP was responsible for what he did.

The true facts were that Mr. Pannu was not an agent or employee of BP, and BP did not have any contractural relationship with Mr. Pannu and was in no way responsible for what he did. Judge Winston Kidd granted BP’s Motion for Summary Judgment, finding that BP was not responsible for what Mr. Pannu did as a matter of law given the undisputed facts in the case.
