Reynolds Obtains Summary Judgment in Construction Litigation Fraudulent Concealment Claim

Asfan, Inc. v. AFC Inc.; in the Circuit Court of Jackson County, Mississippi; Cause No. 2005-00-092(3)

The Plaintiff sued Mr. Reynolds’ client, AFC, Inc., a general contractor, alleging faulty construction of a motel complex in Ocean Springs, Mississippi. Mr. Reynolds filed a Motion for Summary Judgment for AFC, Inc. based upon the statute of repose. The Plaintiff argued that alleged fraudulent concealment of the construction defects tolled the statute of repose.

The trial court ruled in favor of AFC, Inc., finding that a fraudulent concealment allegation does not toll the statue of repose. Thus, Mr. Reynolds’ client was dismissed from the case with prejudice.
