May 14, 2013: Jeffery Reynolds, P.A.’s Victory for Total in Global Warming Lawsuit Upheld On Appeal

The Fifth Circuit Court of Appeals today affirmed the District Court's dismissal with prejudice of the Plaintiffs' global warming lawsuit against Total Petrochemicals USA, Inc., Total Gas & Power North America, Inc. and many other Defendants. Jeff Reynolds was lead counsel in the case for the Total companies.

“The decision strengthens the precedent we had established against the plaintiffs bar's global warming lawsuit campaign,” said Reynolds.

“This benefits not only Total, but all oil companies and indeed the U.S. energy industry in general.”

The Plaintiffs, a purported class of landowners along the Mississippi Gulf Coast, claimed in their lawsuit that the Defendants' greenhouse gas emissions caused or contributed to the phenomenon known as global warming, which in turn caused Hurricane Katrina in 2005 to be a stronger hurricane than it otherwise would have been without the Defendants' emissions, which in turn caused the Plaintiffs to incur property damages and other damages from the hurricane.

“This case represents another victory for the oil industry in these extremely tenuous global warming lawsuits,” said Reynolds.
